By accessing or using HighSMS ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

HighSMS is a platform that allows you to send SMS messages through your own Android phone. The Service provides a dashboard, REST API, and integrations to manage SMS sending via your connected devices and SIM cards.

3. Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activities that occur under your account
  • You must be at least 18 years old to use the Service

4. Acceptable Use

You agree NOT to use HighSMS to:

  • Send spam, unsolicited messages, or bulk marketing without recipient consent
  • Send messages that are illegal, harassing, threatening, or fraudulent
  • Violate any applicable laws or regulations including TCPA, CAN-SPAM, or GDPR
  • Send phishing messages or messages designed to deceive recipients
  • Impersonate another person or entity
  • Interfere with or disrupt the Service

5. Your Responsibilities

  • You are responsible for complying with your mobile carrier's terms of service and SMS limits
  • You are responsible for obtaining proper consent from SMS recipients where required by law
  • You are responsible for the content of all messages sent through the Service
  • You are responsible for maintaining your connected devices and SIM cards

6. Pricing and Payment

  • Pricing is as displayed on our website at the time of purchase
  • All fees are non-refundable unless otherwise stated
  • We reserve the right to change pricing with 30 days notice

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service depends on your device being connected and your carrier network being available. We are not responsible for SMS delivery failures caused by carrier issues, device disconnection, or network problems.

8. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by HighSMS. You may not copy, modify, distribute, or reverse engineer any part of the Service.

9. Limitation of Liability

HighSMS is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these terms. You may cancel your account at any time. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.
