Anti-Spam Policy

Zero Tolerance
HighSMS has a zero tolerance policy for spam. We do not allow the use of our platform to send unsolicited messages of any kind. Every message sent through HighSMS must be to a recipient who has given proper consent to receive it.
This policy exists to protect you, your recipients, and the integrity of the HighSMS platform. Spam damages carrier trust, gets phone numbers blocked, and violates the law.
What Counts as Spam
Any of the following are considered spam and will result in enforcement action:
- Sending messages to people who did not give you consent to contact them
- Purchasing or scraping phone number lists and messaging them
- Sending marketing messages to numbers collected without a clear SMS opt-in
- Continuing to message someone after they have opted out (replied STOP or similar)
- Sending deceptive messages — misleading sender identity, fake offers, phishing links
- Sending messages with prohibited content (see Terms of Service, Section 6)
Consent Requirements
Before sending any message through HighSMS, you must have proper consent from the recipient:
Marketing / Promotional Messages
You need prior express written consent. This means the recipient must have clearly and voluntarily agreed to receive marketing texts from you. Examples of valid consent:
- The recipient texted a keyword to your number to subscribe
- The recipient checked an opt-in checkbox on your website or form specifically for SMS marketing
- The recipient signed a form or agreement that includes SMS consent language
The following are NOT valid consent:
- Having someone's phone number in your contacts
- A business card exchange
- A pre-checked opt-in box
- Consent to receive emails (email consent does not equal SMS consent)
- A purchased or rented phone number list
Transactional Messages
Messages related to an existing transaction (order confirmations, appointment reminders, shipping updates) require prior express consent — the recipient provided their number in the context of the transaction.
Conversational Messages
If someone texts you first (e.g., a customer inquiry), you may reply to their message. This is considered conversational and does not require separate consent.
Opt-Out Compliance
You must honor opt-out requests immediately. HighSMS provides built-in STOP keyword handling:
- When a recipient replies STOP (or similar keywords like END, CANCEL, UNSUBSCRIBE, QUIT), they are automatically added to the opt-out list
- All future messages to that number are automatically blocked
- If a recipient replies START (or SUBSCRIBE, YES), they are removed from the opt-out list and can receive messages again
- Campaigns require STOP opt-out to be enabled on your device before sending
Monitoring
HighSMS actively monitors for spam and abuse. The following automated protections run continuously:
- Opt-out rate monitoring: If your opt-out rate exceeds 5%, your sending is automatically paused to protect your number from carrier spam flags. Sending resumes automatically when the rate drops below 3%.
- Failure rate monitoring: If more than 30% of your outbound messages fail within a 24-hour period (after 50+ messages), sending is paused. High failure rates signal bad number lists or carrier blocks. Sending resumes when the failure rate drops below 15%.
- Duplicate message detection: If the same message body is sent to 50 or more unique phone numbers within 24 hours, sending is paused. This detects template spam blasts. Sending resumes after the 24-hour window clears.
- Volume spike detection: If your 24-hour sending volume exceeds 5x your daily average over the past 7 days, sending is paused. This only applies to accounts that average 20+ messages per day. Sending resumes when volume drops below 3x your daily average.
When any of these protections are triggered, all sending from your account is paused — including campaigns, API sends, AI auto-replies, and missed-call text-backs. You can see your current status on the Dashboard.
Enforcement
Violations of this Anti-Spam Policy will result in the following actions:
- First violation (minor): Written warning with required corrective action within 24 hours.
- Second violation or serious first violation: Immediate account suspension. Your sending capabilities will be disabled pending review.
- Repeated violations or confirmed intentional spam: Permanent account termination with no refund.
We reserve the right to skip directly to suspension or termination for severe violations (e.g., large-scale spam, phishing, illegal content).
Reporting Spam
If you received an unwanted message from someone using HighSMS, please report it to us at [email protected]. Include the phone number the message came from and the message content. We will investigate and take appropriate action.
Your Responsibility
You are solely responsible for the messages sent from your account and devices. HighSMS provides the tools to send messages — you are responsible for using them legally and ethically. Violation of this policy or applicable laws (TCPA, CASL, GDPR, etc.) may expose you to significant legal liability independent of any action we take on your account.
